The Ministry of Education (the ministry) collects, analyzes and reports on information relating to Ontario's early years experiences, elementary and secondary school systems.

The ministry collects and analyzes information from:

This information is provided to the ministry by the persons or organizations instead of directly from the individual to whom the information relates and as such is called an ‘indirect collection of information'.

Schools, school boards and school authorities directly collect student and educator information for their own purposes and are the official sources of such information.

Ministry of Education Collects Limited Personal Information

The ministry collects this limited information throughout the year. The information collected is specific to the ministry's needs and, if it relates to an identifiable individual, such as an individual student or educator, it is considered to be personal information.

The ministry does not collect or use personal information if other information will serve the purpose of the collection or use. The ministry does not collect or use more personal information than is reasonably necessary to meet the purpose of the collection or use.

Use of Information Collected by the Ministry of Education

In order to achieve improved outcomes for students, it is important that education policies, programs and practices are based on evidence. As such, the ministry collects, analyzes and reports on information from schools, school boards and other organizations.

Personal information about students and educators can be collected and used by the ministry for purposes related to the following matters, which are found in the Education Act:

  • administering the Education Act and the regulations, and implementing the policies and guidelines made under the Education Act
  • ensuring compliance with the Education Act, the regulations, and the policies and guidelines made under the Education Act
  • planning or delivering programs or services that the ministry provides or funds, in whole or in part, allocating resources to any of them, evaluating or monitoring any of them, tracking student outcomes and transitions to post-secondary education and/or training or detecting, monitoring and preventing fraud or any unauthorized receipt of services or benefits related to any of them
  • planning or delivering extended day programs, allocating resources to them, evaluating or monitoring them, or detecting, monitoring and preventing fraud or any unauthorized receipt of services or benefits related to them
  • providing for financial assistance related to extended day programs, evaluating or monitoring the provision of the assistance or detecting, monitoring and preventing fraud or any unauthorized receipt of benefits related to the assistance
  • risk management, error management or activities:
    • improve or maintain the quality of the programs or services that the ministry provides or funds, in whole or in part
    • improve or maintain the quality of extended day programs
    • improve or maintain the provision of financial assistance related to extended day programs
  • research and statistical activities that relate to education and are conducted by or on behalf of the ministry

Legal Basis to Collect Information

The ministry has the authority to collect personal information, directly or indirectly, under subsection 8.1(1) of the Education Act R.S.O 1990 c. E.2.

Privacy, Security and Access

With regard to the personal information it collects, the ministry is bound by privacy protection rules under the Freedom of Information and Protection of Privacy Act (FIPPA) and takes all necessary steps to safeguard the personal information collected.

Individuals also have a right to access their own personal information under FIPPA. (Access to Information and Privacy Protection)

Child Care and Early Years

Information Sources

The Ministry of Education (the ministry) collects and analyzes information relating to Ontario's child care and early years sector. The ministry collects and analyzes information from:

  • members of the public
  • other ministries, agencies, institutions or entities as required, including:
    • children's aid societies
    • municipal authorities
    • schools, school boards, and school authorities
  • any other person or organization who might have information relevant to enforcement activities

This information is provided to the ministry by the persons and organizations listed above instead of directly from the individual to whom the information relates and as such is called an ‘indirect collection of information'.

Ministry of Education Collects Limited Personal Information

The ministry collects this limited information throughout the year. The information collected will be specific to the ministry's needs and, if it relates to an identifiable individual, it is considered to be personal information.

Use of Information Collected by the Ministry of Education

Personal information may be collected and used by the ministry for the following purposes which are found in the Child Care and Early Years Act, 2014 (the Act):

  • administering the Act and the regulations
  • ensuring compliance with the Act and the regulations
  • with respect to child care and early years programs and services that the ministry establishes, administers, operates or funds, in whole or in part:
    • planning, delivering, evaluating and monitoring the programs and services
    • allocating resources to the programs and services
    • detecting, monitoring and preventing fraud and the unauthorized receipt of services and benefits related to the funding
  • to determine or verify a person's eligibility to participate in a child care or early years program or service or to receive financial assistance under the Act
  • implementing risk management, error management or activities to improve or maintain the quality of the programs and services that the Ministry provides or funds, in whole or in part
  • conducting evaluations of child care and early years programs and services
  • conducting research and analysis, including longitudinal studies, surveys, and statistical activities conducted by or on behalf of the Ministry for purposes that relate to:
    • child care and early years programs and services
    • education
    • the transition from child care and early years programs and services to school, and the resulting outcomes
    • the matters of provincial interest under section 49 of the Act
    • programs and services that support the learning, development, health and well-being of children, including programs and services provided or funded by other ministries

Legal Basis to Collect Information

The ministry has the authority to collect personal information, directly or indirectly, under subsection 70 (1) of the Child Care and Early Years Act, 2014.

The ministry does not collect or use personal information if other information will serve the purpose of the collection or use.
